Welcome to 24KMEDIA. These Terms and Conditions ("Terms") govern your use of our website and the videography, production, post-production, and branding services (collectively, the "Services") provided by 24KMEDIA ("we," "us," or "our"), based in New Zealand.

By accessing our website or engaging us for production services, you agree to comply with and be bound by these Terms. If you do not agree, please do not use our website or services.

1. Scope of Services

24KMEDIA provides professional visual production services, including but not limited to music video production, live event capturing, tour videography, visual effects (VFX), and branded content creation. Each specific project will be governed by an individual Project Agreement, Quote, or Statement of Work (SOW) detailing the specific deliverables, timelines, and fees.

2. Booking and Payments

Deposits: To secure a production date, a non-refundable deposit (specified in your SOW) is required at the time of booking.
Payment Schedule: Remaining balances are due according to the schedule outlined in your project contract (typically upon completion of filming or prior to the delivery of the final cut).
Late Payments: We reserve the right to suspend all editing, VFX processing, or final file delivery if payments are not made by the specified due dates. All pricing is processed in New Zealand Dollars (NZD) unless stated otherwise.

3. Cancellations and Rescheduling

Client Rescheduling: If you need to reschedule a shoot, you must notify us at least 48 hours prior to the scheduled session. Failure to do so may result in a rescheduling fee or forfeiture of your deposit.
Weather and Force Majeure: For outdoor shoots (such as music videos or live events), if hazardous weather or conditions beyond our control make filming impossible, 24KMEDIA will work with you to reschedule at no additional creative cost, though third-party location or permit fees may still apply.

4. Intellectual Property and Copyright

Ownership: Unless explicitly agreed upon in writing in a signed creative contract, 24KMEDIA retains the underlying copyright to all raw footage, unedited project files, and conceptual treatments generated during production.
Client License: Upon full and final payment, the Client is granted a non-exclusive, perpetual, worldwide license to distribute, broadcast, and display the final produced media asset (e.g., final music video, commercial, social media cut) for its intended promotional or commercial use.
Promotional Rights: 24KMEDIA retains the right to display portions of the final video, behind-the-scenes footage, and project stills on our website, social media channels, and digital portfolios for self-promotional, marketing, and showreel purposes.

5. Creative Control and Revisions

Creative Freedom: We pride ourselves on delivering a modern, cinematic edge. The client trusts our creative direction, stylistic choices, and editorial judgment.
Revision Rounds: Standard video packages include a set number of revision rounds (typically two rounds of minor edits), which must be requested within 7 days of receiving the initial draft. Extensive revisions, structural re-editing, or late VFX changes requested outside the agreed scope will incur additional hourly post-production fees.

6. Code of Conduct and Safety

We are committed to a safe and respectful working environment. 24KMEDIA reserves the right to immediately cease filming or terminate a project without a refund if our crew, directors, or equipment are subjected to unsafe working environments, illegal activity, or hostile behavior on set.

7. Limitation of Liability

While we use industry-standard equipment, data redundancy protocols, and backup workflows, 24KMEDIA is not liable for indirect or consequential losses resulting from technical equipment failure, data corruption, or event cancellations beyond our reasonable control. Our total financial liability for any claim shall not exceed the total amount paid by the client for the specific service.

8. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of New Zealand. Any disputes arising out of or in connection with our services shall be subject to the exclusive jurisdiction of the courts of New Zealand.

9. Modifications to Terms

24KMEDIA reserves the right to update or modify these Terms at any time without prior notice. Continued engagement of our services following any changes constitutes your acceptance of the revised Terms.
